Another court declares Ohio school choice voucher program unconstitutional10/16/2026COLUMBUS, Ohio (AP) — Another court has declared Ohio's school choice voucher program unconstitutional. While leaving the EdChoice program in place for now, a three-judge panel of the 10th District appellate court affirmed a lower court ruling finding the program violates an Ohio constitutional provision requiring the state to maintain a system of common schools. The judges found the “choice” provided falls to private schools and not families and that EdChoice harms public schools financially. Republican Ohio House Speaker Matt Huffman, a school choice champion, said there's ample legal precedent affirming the constitutionality of vouchers and this latest ruling “will not affect that.”
